These inspections aim to assess compliance with regulatory standards, Good Manufacturing Practices (GMP), and other requirements. Inspections may be scheduled or unannounced, and they can cover various aspects of facility operations, such as production processes, quality control, sanitation, and record-keeping. 

Warning Letters 

When the FDA identifies violations of regulatory requirements during inspections or through other means, it may issue warning letters to regulated companies. Warning letters outline specific violations and request corrective actions within a specified timeframe. Failure to address the issues raised in a warning letter may result in further enforcement actions. 

Recalls 

The FDA has the authority to initiate recalls of products that pose a risk to public health or safety. Recalls may be conducted voluntarily by manufacturers or mandated by the FDA through regulatory action. The FDA classifies recalls based on the level of risk posed by the product, ranging from Class I (most serious) to Class III (least serious). Import Alerts 

The FDA monitors imports of regulated products into the United States and may issue import alerts to detain or refuse entry to products that violate regulatory requirements. Import alerts specify the criteria for detention and provide guidance to FDA field personnel on inspection, sampling, and testing procedures for imported products. Import alerts may be issued based on factors such as adulteration, misbranding, or safety concerns. 

Seizures and Injunctions 

In cases where voluntary compliance measures are insufficient to address violations of FDA regulations, the agency may pursue legal action, including seizures and injunctions. Seizures involve the physical removal of adulterated or misbranded products from the market, while injunctions seek court orders to halt the manufacture, distribution, or sale of non-compliant products. 

Criminal Investigations and Prosecutions 

The FDA’s Office of Criminal Investigations (OCI) investigates suspected violations of federal laws related to food, drugs, medical devices, and other regulated products. OCI works closely with other law enforcement agencies to gather evidence, conduct raids, and prosecute individuals or companies engaged in illegal activities, such as product counterfeiting, smuggling, fraud, or other criminal offenses.
